How to obtain a residence permit in the UK after 31 December 2020

The United Kingdom has left the European Union, and this will have an effect on Romanians living and working in the UK. In order to continue to benefit from their current rights in the UK, Romanians in the UK before 31 December 2020 must apply for the new residence status in the UK, respectively “settled” or “pre-settled status”, by 30 June. 2021.

The end of the transition period (31 December 2020) will mark the end of the application of European law in the UK. European citizens (including Romanians) arriving after this date will be subject to the new immigration regime valid from January 1, 2021.

How do you know what status to apply for:

  • The SETTLED Statute applies to European citizens and their family members who have resided in the United Kingdom for an uninterrupted period of 5 years on the date of application.
  • PRE-SETTLED status applies to those who have lived in the UK for a period of less than 5 years, until 31 December 2020 and allows them to accumulate the 5 years required for the SETTLED application (it is mandatory to apply for the status of settled before the expiration date of the pre-settled status).

Applicants must prove: nationality, identity, continuing residence * and provide criminal record data ** (if any).

* Continuing residence means that absences from the UK must not exceed 6 months or less compared to any period of 12 months.

** EU citizens with criminal convictions of more than one year in prison will not be able to enter the UK from January 1, 2021, the British Home Office announced.

Residence Card – must also apply for status under the new registration system

Indefinite Leave to Remain – it is recommended to apply for the new status

Only people who are already in the UK before 31 December 2020 can apply for the new resident status!

Applications must be submitted by June 30, 2021!
