Pre Settled Status application – UK

Apply for a residence or pre-residence permit in the UK. After June 30, you will not be able to

June 30, 2021 is the last day on which it will be possible to apply for a residence or pre-residence permit in the United Kingdom. In other words, you need to think hard and make a decision before the pressure of time becomes too great.

Vaccination results are increasingly encouraging (the UK is doing very well in this regard), and the British government has already announced a timetable for lifting restrictions, resuming activities (including the reopening of bars and restaurants), and a return to life. normal.

The chances of this happening in the UK this year are quite high, and the resumption of economic activities is likely to attract a large demand for labor. But because of Brexit, the rules have changed: EU workers (and, implicitly, Romania) are no longer free to work freely in the UK, but according to new rules. And one of those conditions is to get a residence or pre-residence permit in the UK.

To apply for such a permit, you must prove:

  • identity
  • residence in the United Kingdom (unless you have a valid permanent residence permit or a valid residence permit or stay in the United Kingdom indefinitely

When you apply for the transition from pre-residence to residence status, you must prove it again.

Proof of identity

You must have a valid passport or ID card. You also need to present a photo in digital format with your figure.

If you also apply for your child, you must prove his identity. You may also need to prove your residence in the UK.

When you apply, you can also:

  • scan documents and upload your photo using the EU Exit: ID Document Check app for Android or iPhone 7 and newer phones
  • send documents by mail and upload your photo using the online application

Proof of continued residence

To be able to obtain a residence permit, you must have lived in the UK, the Channel Islands or the Isle of Man for at least 6 months out of 12 consecutive years, for 5 years in a row. You must prove this when applying.

If you have not lived here for 5 consecutive years, you can apply for a pre-residence permit.

If you arrived in the UK before 31 December 2020, you can provide your National Insurance number (NINO) for an automatic residence check based on taxes paid and benefits received.

If the verification confirms the data, no additional evidence or documents are required.

You only need to submit documents if you have been in the UK for 5 years in a row, but there is not enough information in the database to confirm this.

The Home Office will notify you immediately after you apply if other documents are needed or not.

Pictures and documents are better sent in electronic format than by mail.

If you have a criminal record

If you are 18 years of age or older, the Home Office will check if you have committed serious or repeated crimes and if you are in any danger.

You will need to declare whether you have been convicted in the UK or abroad.

You do not have to state the following:

  • dfe convictions that have passed a period of time (spent convictions)
  • warnings
  • contraventions (eg traffic fines)

You will also be checked in the UK database.

You can obtain a residence or pre-residence permit if you have committed minor offenses.

You can obtain a residence or pre-residence permit if you have various convictions. Each case will be judged separately.

If you have been imprisoned, you must usually have 5 years of continuous residence from the day of release in order to obtain a residence permit.

If you apply to join the family

You must prove your family relationship with the other members.

If your UK relative does not yet have a residence or pre-residence permit, you will need to prove their identity, nationality and that they have lived in the UK (for example, bank documents).
